1. Scope

 

The general Terms & Conditions of sale detailed below (hereinafter referred to as the "General Conditions") govern the contractual relations between any user of the Muzeo.fr site (hereinafter referred to as "the Customer") and the sales site online Muzeo.fr belonging to the company Muzeoweb located at 31 avenue Léon Gambetta, 92120 Montrouge, France whose intra-community VAT number is FR58 538916560 and registered in the Paris Trade and Companies Register under number 538 916 560. Muzeoweb is a subsidiary of Muzeo. Muzeoweb's main activity is the sale of goods on the Muzeo.com site.

These general conditions of sale are the only ones applicable and replace all other conditions, except prior, express and written exemption. Muzeoweb may from time to time modify some of the provisions of its general conditions. Consequently, it is necessary that the Customer becomes aware of the version in force on the day of his order on the Site. These changes are enforceable against the Customer from the time they are posted online and will be applied to orders after the date they are posted online. Any purchase on the Site is subject to all the clauses of the Terms & Conditions. The Customer may only validate his order after having duly taken note of it and having accepted it by checking the icon dedicated for this purpose.

By validating the General Terms & Conditions, the Customer declares to have the legal capacity allowing the conclusion of a contract within the meaning of articles 1123 and following of the French Civil Code. The Customer must guarantee the veracity and accuracy of the information provided and use the site in accordance with the general conditions of sale. Muzeoweb reserves the right to cancel or refuse any order from a customer with whom there is a dispute relating to the payment of a previous order.

 

2. Products

 

The products sold on the Muzeo.com site are reproductions of works of art printed on various supports and framed or not. These reproductions are available in several formats, on several supports, in limited edition and numbered or not, depending on the agreement between Muzeoweb and its partners. Muzeoweb works with many partners: the Réunion des Musées Nationaux, the BNF, specialized agencies such as Getty or Bridgeman as well as certain artists live or through ADAGP (the French society for the collective management of copyright in visual arts). Muzeoweb strives to keep its catalog up to date, however in view of the large number of partners, it may be that an image becomes unavailable from a partner but is still available on the Muzeo.com site for a few days. In any event, only the confirmation of the purchase by email from Muzeo.fr guarantees the Customer the availability and delivery in the General Terms & Conditions.

 

3. Prices

 

 

The prices are indicated all taxes included, excluding participation in shipping costs. Only payments in euros are accepted on the Muzeo.com site.

The price to be paid may be reduced by a discount (for example coupons or vouchers). The price will not be final until confirmation of the order.

Muzeoweb reserves the right to modify its prices at any time. The works will be invoiced on the basis of the prices in force at the time of the registration of the order.

The works remain the property of Muzeoweb until full payment of the price indicated.

In the event of a change in the VAT rate, the price will be automatically changed without any other notice than the legal due date for the new rate.

 

4. Order process :

 

In order to place an order, the customer must follow the following steps:

  • Consultation of the page of a work. On this page, the customer will have to choose: the support, on which the available sizes depend as well as a frame and various options if desired. Alternatively, he can select the "Muzeo recommendation" which presents a work with a support as well as a predefined size and frame.
  • Click on the button "add to cart" a confirmation pop in opens. The customer can then go directly to payment or continue shopping on the Muzeo.com site.
  • Cart page: The customer can delete an article or modify the quantities ordered.
  • Identification page or account creation
  • Address page where the customer can choose his delivery and billing addresses
  • Delivery choice page
  • Payment page: the customer can use his reduction coupon, select his means of payment and check the various elements constituting the order.
  • The customer must then accept these general conditions of sale to confirm the order and make payment according to the method chosen. Their acceptance is done by checking the box in front of the link to these conditions.
  • The order is effective upon confirmation of payment by the bank, which will be notified to the customer by email.

 

5. Payment methods and security

 

Several payment methods are available on the Muzeo.fr website:

  • Credit Card, Visa , Mastercard
  • Paypal
  • Check (payable to Muzeoweb)
  • Bank transfer

 

 

 

 

For any bank transaction (credit card, Visa, Mastercard) the bank transaction is processed and secured by Mercanet, the BNP PARIBAS payment platform.

Credit card payments are made entirely on BNP's secure servers.

Muzeo.com never has access to your banking information. In addition, all information is encrypted using the SSL protocol and cannot be intercepted or modified.

In the case of payment by check or transfer, the production of your order will not start until the check has been cashed or the transfer received, which generally adds a few days to the processing of the order. You will find our bank details during the payment stage of your order.

Muzeoweb cannot be held liable for damage resulting from the use of electronic means of communication, including - but not limited to - damage resulting from a failure or delay in the transmission of electronic communications, interception or the manipulation of electronic communications by third parties or by computer programs used for electronic communications and for the transmission of viruses.

 

6. Delivery (including costs and deadlines)

 

Shipping costs depend on the size and weight of your order. Muzeoweb works in partnership with Geodis in France and DHL internationally

The Customer must carefully fill in all the fields of the delivery form at the time of the order, including his delivery details and a telephone number. Neither Muzeoweb nor Geodis nor DHL can be held responsible for a delivery failure due to an inaccuracy or error in the delivery address.

Delivery times are around 8 working days on average. Due to the production on demand of the Products and the vagaries associated with obtaining high definition images from our partners, these times may vary and Muzeoweb cannot be held responsible for them. In any event, the delivery time of the Products will not exceed three (3) weeks from the receipt by the Customer of the confirmation of his order.

Prices and shipping costs are indicated in Euros / Pounds. The price is payable in full and in a single payment upon order. All orders are invoiced and payable in Euros / Pounds only. For any delivery outside of mainland France, any customs fees or local taxes remain the responsibility of the recipient.

Our product offers and prices are valid as long as they are visible on the site, while stocks last. For products not stored in our warehouses, our offers are valid subject to availability from our suppliers. In this context, indications on the availability of products are provided at the time of placing your order. This information coming directly from our suppliers, errors or modifications may exceptionally occur. 
In the event of unavailability of products not stored after placing your order, we will notify you by email upon receipt of the information sent by the suppliers. Unless you want a replacement for equivalent equipment, your unavailable order will be automatically canceled and you will be reimbursed if your bank account has been debited.

In "my account;", the customer can follow the progress of his order. They can find their order tracking number there. It is then enough for the customer to connect to the DHL / Geodis site to track their delivery in real time.

Muzeo delivers worldwide. For any specific question and delivery outside mainland France and European Union, please contact our customer service by email:[email protected]  or by phone  +33 (0)1 84 80 55 35 ( 9h30 am – 12h30 am and 2 pm - 6h30 pm  from Monday to Frisay). Our customer service will establish a personalized delivery quote for shipments outside of mainland France.

 

7. Receipt of Delivery and Right of Return

 

Upon delivery, the buyer is required to check the goods. Any reservations he intends to make on the condition of the goods delivered must be mentioned on the delivery slip.

In the absence of mention on the delivery slip, no complaint will be admitted after reception of the goods, except in case of hidden defect

 

8. Force Majeure

 

Muzeoweb cannot be held responsible for a delay or an impossibility of processing a customer's order occurring due to one or more external events, beyond his control and control and reasonably insurmountable, defined as force majeure events as defined by applicable law and the elements below.

Shall be considered as events of force majeure, in particular, destruction of equipment, computer attacks or hacking, deprivation, suppression or prohibition, temporary or permanent, and for whatever reason, of access to the Internet and cases recognized according to case law.

 

9. Cancellation and withdrawal

 

In accordance with article L121-20 of the French consumer code, the customer has a right of withdrawal, without giving any reason, to return a work within 14 days after the order confirmation. This right does not apply to gift voucher orders or orders placed by companies.

In this case, the customer will contact Muzeoweb as soon as possible by telephone on +33 (0) 1 84 80 55 35 (9.30 a.m. - 12.30 a.m. and 2 p.m.- 6.30 p.m. from Monday to Friday) or by e-mail at [email protected] indicating CANCELLATION in the subject of the e-mail.

 

10. Returns

 

For any order on the Site, the customer has a period of 14 days from receipt of the order to return the order in its original packaging.

The Customer must contact Muzeoweb customer service as soon as possible. Returns will be free, the customer will ask the customer service for a return label and drop off their package at a UPS collection point

As indicated on the voucher provided for this purpose, the product must be returned to 31 avenue Léon Gambetta, 92120, Montrouge

If the returned product is in its original condition, the reimbursement period is 30 days maximum from the date of receipt of the product by Muzeo. Refunds will be made by bank transfer to the account used for payment or by bank check depending on the payment method used when ordering.

 Muzeoweb will reimburse the price of the returned items as well as the initial shipping costs.

 

11. Guarantee and Liability

 

Muzeoweb guarantees the conformity of the works sold on the site with the prescriptions of French law.

Muzeoweb reserves the right to correct the content and information published on the Muzeo.fr site at any time and without notice. Muzeoweb does not guarantee the accuracy and correctness of this information (including but not limited to descriptions of works, artist biographies, dates, etc.). 


Muzeoweb declines any responsibility for any interruption of the site, any occurrence of technical problems, any inaccuracy or omission relating to information available on the site, any damage resulting from a fraudulent intrusion by a third party leading to a modification of the information made available on the site.

Muzeoweb cannot be held responsible for problems with access or content on third-party sites, even if these are partners posting a link on Muzeo.fr

Muzeoweb will not be liable for damages resulting from the use or inability to use the Site or from malfunctions attributable to third-party software incorporated into the site;

The choice and purchase of a reproduction are the sole responsibility of the customer.

 

12. Intellectual property

 

a. Muzeo

 

 

Muzeo, Muzeo.com and Muzeoweb are protected trademarks registered with the INPI and www.Muzeo.com is a protected domain name. They are the exclusive property of Muzeo and Muzeoweb and cannot be used without our prior agreement. Any link with other sites without the prior consent of Muzeoweb is strictly prohibited.

All the elements present on the site and the site itself are protected by copyright, trademark law, designs and / and any other intellectual property rights. By elements, we mean in a non-exhaustive manner: photographs, images, drawings, illustrations, texts, videos, logos, screensavers, wallpapers, brands, models, software… These elements belong to the company Muzeoweb or else are used with the agreement of their owners.

With regard to the photographs of the works, Muzeoweb uses them on its site under the right of representation in agreement with its partners. The images always show the mandatory information.

As such, any reproduction, representation, use, adaptation, modification, incorporation, translation, marketing, partial or complete by any process and on any medium whatsoever is prohibited without the prior written permission of Muzeoweb.

 

b. Works

 

The artist or the rights holders remain the copyright owners of the works within the meaning of French law. The rights of representation and reproduction of works are governed by a contract between Muzeoweb and its partners. The joint authorization of Muzeoweb and its partners is therefore necessary for any exploitation of these rights.

For each sale, Muzeoweb pays a defined percentage to the beneficiaries. Copyright is included in our sale prices.

Muzeoweb fully manages the rights. Muzeoweb guarantees that the exploitation of all of these images is done in full transparency, respecting the rights of reproduction and copyright.

The sale of reproduction on Muzeo.com gives the right to private use. If in doubt contact us.

 

13. Protection of confidential data

 

Muzeoweb is committed to protecting the privacy of its visitors and customers. The automated processing of personal information has been declared to the National Commission for Data Protection under the number 1621809.

In application of the Data Protection Act of January 6, 1978, you have the right to access, modify, rectify and delete data concerning you. You can exercise this right by sending us a email ([email protected]) or a letter to the following address:

As part of its commercial activity, Muzeoweb collects personal data provided voluntarily, in particular when registering any new member to the Muzeo.com site. Registration is required for any Customer wishing to place an order. Muzeoweb undertakes to use Personal Data only in the context of the operation of the Site. Muzeoweb undertakes not to transfer or rent Personal Data.

Personal Data is mainly used to manage customer orders.

When registering, the client in this respect acknowledges consenting to the use of its email address for any communication on the part of Muzeo.fr, including but not limited to Muzeoweb newsletters. The customer may choose to unsubscribe from these communications using the link provided for this purpose in the emails in question.

Muzeoweb makes every effort to ensure the confidentiality and the security of the data which could be seized or transmitted on its services, but could not however be held responsible for their deterioration, loss, or accidental "hacking" which could occur in spite of all the precautions taken implemented. The user of the service, subscribed or not, therefore releases Muzeoweb from any lawsuit and any claim for damages following the loss and / or hacking of data.

 

14. Applicable right

 

These general Terms & Conditions are subject to French law. Any dispute relating to the validity, interpretation and / or execution of these general conditions of sale, even in the event of a warranty claim or multiple defendants, will be the exclusive jurisdiction of the Paris Commercial Court.

 

15. Severability of clauses

 

The fact that any clause of the Terms & Conditions becomes void, unenforceable, lapsed, illegal or unenforceable due to a law, a regulation or following a court decision, cannot call into question the validity, the legality, the applicability of the other stipulations of the General Terms & Conditions and will not exempt the Client or Muzeoweb from the execution of its contractual obligations.
